Buying Off-Plan Property in the UAE

Off-plan purchases have different milestones and risks from buying a completed home. The exact rules depend on the emirate and the project.

What is off-plan property?

Off-plan property is a unit bought before construction is complete, often directly from a developer. The buyer signs a sale agreement for a planned or partly built home and receives the completed unit later, subject to the contract. Review the approved project details, specifications, completion timetable and registration requirements before paying a deposit.

How does an off-plan payment plan work?

A payment plan divides the purchase price into instalments, commonly linked to dates or construction milestones, with a balance due at handover or another agreed stage. The schedule is set by the developer and the sale agreement, so it differs by project. Check when each payment is due, whether it depends on verified progress, and any late-payment terms.

Is it safe to buy off-plan property in the UAE?

No purchase is risk-free. In Dubai, developers must register off-plan projects and open project escrow accounts, and initial sales are registered with the Dubai Land Department. These safeguards do not guarantee completion or a return. Verify the project and developer through official channels, understand the contract and payment schedule, and obtain independent advice before committing.

What happens if an off-plan developer delays the project?

Start by checking the project status and your sale agreement for the completion date, grace period and remedies. In Dubai, the Land Department offers a project-status service and has procedures for stalled or cancelled projects. A delay does not automatically mean an immediate refund; the outcome depends on the contract and the project circumstances. Seek qualified legal advice for a dispute.

What should I check before signing an off-plan purchase agreement?

Confirm the developer, project registration, escrow details, unit number, area, specifications, expected handover date and full payment schedule. Read the clauses on changes, delay, cancellation, resale and service charges. Keep copies of all documents and receipts. Rules differ across emirates, so confirm the relevant land authority requirements and ask an independent professional to review unclear terms.
